Anthony man accused of attacking family member who suggested he go to rehab

An Anthony man is being held in the Marion County Jail after allegedly battering a family member over the age of 65 who brought up the topic of alcohol rehabilitation.

A Marion County sheriff’s deputy responded to a domestic battery call Tuesday night at a home on NE 47th Avenue in Anthony. The woman who called 911 said her father was pushed down and spit on by 55-year-old Raphael Joseph Blain, who also lives at the residence. The woman said she did not witness the incident but has experienced problems with Blain threatening them for several weeks, a sheriff’s office report states.

The victim told deputies that Blain returned home intoxicated and that when he initiated a conversation about rehab, Blain became angry, pushed him down with two hands and spit in his face. The victim said Blain left the residence a short time later. The deputy did not see any injuries on the victims but observed he was extremely upset, the report says.

After being read his Miranda rights, Blain told the deputy he and the victim argued, but he denied pushing him down and spitting on him. He said he left the location to avoid a physical altercation with the victim, the report says.

Blain was arrested and charged with domestic battery on a victim 65 years or older. He remains held on $1,000 bond and awaits an April 23 hearing in Marion County Court.
