Drug charges added to Fort McCoy man’s domestic battery beef

A Fort McCoy man who was being arrested on a domestic battery charge had drug charges added after THC and a vape pen were discovered in a search of his pockets.

A Marion County sheriff’s deputy responded to the home of Daniel Carman Cerrato, 35, of NE 243rd Place, on Tuesday to assist the state Department of Children and Families with a domestic violence investigation. The victim had told a DCF investigator the previous day that Cerrato pushed her out of his truck on May 8, causing her to fall to the ground and cut her leg, according to the sheriff’s office report.

During the DCF investigation, Cerrato admitted to pushing the victim out of his truck, and he admitted it again to the deputy. He said he pushed her out because she refused to exit the vehicle after they had an argument, the report said.

After placing Cerrato under arrest, the deputy found a black pen-shaped device in Cerrato’s front-right pants pocket. Cerrato said it was the vape pen he uses to ingest medical marijuana. He said he is prescribed medical marijuana, but he didn’t have the prescription in his possession, according to the report.

The deputy also found a brown waxy residue inside the pen and in a syringe that was in Cerrato’s backpack. The substance field tested positive for THC, the active ingredient in marijuana, the report said.

Cerrato was charged with domestic battery, possession of THC oil, and possession of drug paraphernalia. He was taken to the Marion County Jail, where he was released Thursday on $4,000 bond. He’s scheduled to appear in Marion County Court on June 25.
