Locked-out Umatilla man accused of battering woman

A 38-year-old Umatilla man was arrested on a battery charge Sunday after he allegedly battered a woman who wouldn’t let him take items from their home to sell for drug money.

Javier Timoteo Avellaneda, of SE 252nd Avenue, was charged with felony battery, second or subsequent offense. He was previously convicted of battery in Volusia County in 2003 and Marion County in 2004, according to the Marion County Sheriff’s Office report.

A deputy responded to Avellaneda’s home and found him sitting in his minivan in the driveway. Avellaneda said he lives at the residence and that an eyewitness had changed all the locks so he couldn’t get inside, according to the report.

The witness said Avellaneda is highly addicted to illegal narcotics and she wanted him out of the residence, so she changed the locks. She said that on Saturday, Avellaneda walked into the home and told her he was going to take some things from inside to sell. She said she told him no and he became irate, the report said.

The witness said she and the victim were standing in the hallway, telling Avellaneda he wasn’t going to take anything, when he grabbed the victim by the arms and threw her to the floor. The witness said she told Avellaneda she was going to call the police and he left the residence, according to the report.

The victim said Avellaneda has been gradually becoming angrier in recent weeks due to his use of illegal narcotics. She said he walked into the residence and said he was going to take items and sell them. The victim said she was standing in the hallway, trying to talk to him, and he grabbed her by the arms and threw her with such aggression that she ended up on the floor. She said the witness told Avellaneda she was going to call the police and he left. A second witness corroborated the first two accounts, the report said.

Avellaneda denied touching victim. He was arrested and taken to the Marion County Jail, where he was being held Monday on $5,000 bond. He’s scheduled to appear in Marion County Court on Oct. 15.
