Ocala man charged with trespassing and taking child from mother

An Ocala man was arrested for allegedly barging into a home where he had been previously trespassed and taking his child away from the mother.

Manuel Humberto Ortiz, 20, of 1311 NE 55th St., was charged with trespassing and burglary with assault or battery after the incident, which happened Thursday at the victim’s residence on NE 77th Loop.

The woman who called 911 told a Marion County sheriff’s deputy she was at home with her daughters when Ortiz came to the residence demanding to see the child. The reportee said she told Ortiz that he needs to leave due to the fact he was trespassed from the home on July 13. She said Ortiz ignored her instructions and entered the home unlawfully to get the child, according to the sheriff’s office report.

The reportee said one of her daughters tried to stop Ortiz from entering further into the home, but Ortiz pushed her and elbowed her several times to keep her from stopping him. She said Ortiz went to the bathroom, where her other daughter was with the child, and took the child from her, the report said.

The reportee said Ortiz did not have permission to enter the home and has never lived at the residence. She said he entered the home with such force that it caused the sliding metal doors in the hallway fall off their hinge, which the deputy observed, according to the report.

The daughters’ statements corroborated the reportee’s account. The child’s mother said there is not a custody order in place and that she and Ortiz each have 50 percent custody through a mutual agreement. The deputy did not observe any injuries on the other daughter, the report said.

Ortiz was not located at the scene and a probable cause affidavit was issued for his arrest. He was apprehended Thursday and taken to the Marion County Jail, where he was released the next day on $10,500 bond. A court date was not set.
