Belleview man restrained in police car after DUI arrest

A Belleview man found sleeping in his car at a Wawa parking lot had to be placed in a hobble restraint while he was being taken to jail on a drunk-driving charge.

Howard David Shook, 58, of 7814 E Highway 25, Unit 1, was charged with DUI and resisting an officer without violence after the Nov. 21 incident. He’s still being held in the Marion County Jail on $1,500 bond.

A Belleview Police officer responded to the Wawa at 5726 SE Abshier Blvd., where Marion County Fire Rescue paramedics had been called about a man asleep in a vehicle. A paramedic told he officer he found Shook asleep in the driver’s seat with the keys in the ignition and the power on, but the car wasn’t running. He said he could smell a strong odor of an alcoholic beverage, according to the police report.

The store employee who reported the incident said a customer told her there was a man asleep in his car. She said she approached the vehicle and called out to the man, later identified as Shook, but he didn’t answer. The employee said she got close enough to see the man was breathing and she smelled an alcoholic beverage, the report said.

The officer then approached Shook, who was sitting in the driver’s seat of a white Dodge Durango. Shook said he had about three beers earlier in the evening, and that he came to the store to sleep before going to Tavares. He refused to be taken to the hospital by paramedics, according to the report.

The officer smelled a strong odor of an alcoholic beverage and observed Shook’s eyes were watery and glassy, and his speech was slurred. Shook agreed to participate in a series of field sobriety exercises, and he failed each one and was placed under arrest, the report said.

The officer searched Shook’s car and found four cans of Executioner IPA beer. They were ice cold and one was open and mostly empty. There was also one warm can of Swamp Head beer. The mostly empty can of Executioner was in the cupholder, according to the report.

While on the way to jail, Shook became agitated and started screaming and cursing at the officer. He then started yelling he was going to kill himself and kicking the windows and door. The officer warned Shook to stop and he failed to comply, so she pulled over in the 10900 block of U.S. Highway 441 and secured him in the hobble. Shook refused to get back into the patrol car and continued to curse and call names, and he had to be assisted into the back seat, the report said.

At the jail, Shook was cursing, crying and laughing before he eventually calmed down. A breathalyzer test at the came back with readings of 0.137 and 0.128, according to the report.

Shook told the officer he was in Ocala earlier with some friends and consumed three beers. He said he was on his way to Tavares for some work when he stopped in Belleview to pick up items out of storage. He said he then stopped at Wawa to sleep, the report said.

Shook said he had about six hours of sleep the previous night. He said he was definitely not under the influence, but he could feel the effects of the alcohol. Shook was placed under a Baker Act and taken to the Centers, where he stayed until being taken back to jail on Nov. 25, according to the report.

Shook is scheduled to appear in Marion County Court on Dec. 23.
