Belleview man charged with sexually assaulting passed-out woman

A 26-year-old Belleview man was arrested on a sexual assault charge after he allegedly made sexual contact with a woman while she was unconscious in his bed.

The victim told a Marion County sheriff’s deputy recently that the previous night, she picked up her friend and they went back to his residence, where Raimec Ronald Jones also lives. The victim said while at the residence, she drank three beers and was hanging out and watching TV with both men in Jones’ room, according to the sheriff’s office report.

The victim said she asked Jones to hold her last beer before she finished it, and at around 1 a.m. she asked her friend to go get her e-cigarette out of her car. She said she didn’t recall much of what happened after that and she passed out on Jones’ bed, the report said.

The victim said she woke up at around 4 a.m. and her pants were pulled down to her mid-thigh. She said she was laying on her side and Jones was behind her, and she believed Jones was penetrating her vagina with either his fingers or penis. The victim said she immediately asked Jones where her keys were so he would know she was awake, and that Jones immediately stopped touching her, according to the report.

The victim said she took a Xanax at around 9 p.m., but she normally takes this medication and it doesn’t cause her to pass out, even if she has a few drinks. She said she has never been in a relationship with Jones, nor has she ever had sexual intercourse with him. The victim said at no time did she consent to him touching her, the report said.

Jones willingly spoke to the deputy about the incident and was told he was free to leave at any time. Jones said the victim was drinking alcohol with him and they were both intoxicated. He said the victim was in his room while he was intoxicated so he figured she wanted to “mess around,” according to the report.

Jones said he started kissing on the victim and touching her. He said he was shaking the victim to wake her up and she mumbled, so he assumed she was drunk and awake. Jones said he pulled her pants down and began to digitally penetrate her with two fingers. He said the victim became upset with him that he touched her “kitty” and she left the residence, the report said.

Jones’ roommate confirmed the victim was in the bedroom with him and Jones, and that they had some beers. He said the victim started falling asleep and he left the room and went into another room, according to the report.

Contacted later by phone and asked whether she had done anything with Jones that he was alleging, the victim said at no time did she kiss or do anything sexual with him, the report said.

The deputy drafted a probable cause affidavit for one count of sexual assault and Jones was arrested on Wednesday. He was released Friday from the Marion County Jail on $25,000 bond and is scheduled to appear in Marion County Court on March 10.
