Video catches Ocala men in Fourth of July attack

Two Ocala men were arrested after they were caught on video attacking a man and woman and causing property damage at a Fourth of July party.

Michael Myers, 38, of 343 SW 78th Court, was charged with aggravated assault with a  deadly weapon without intent to kill, battery (second or subsequent offense), possession of less than 20 grams of marijuana, possession of drug equipment, and criminal mischief with less than $200 in damage. John Peter Dalton, 43, of 7697 SW 2nd Place, was charged with simple battery and criminal mischief with between $200 and $1,000 in damage.

Multiple Marion County Sheriff’s Office units responded to the incident location on SW 2nd Street at around 10:45 p.m. Saturday. The male and female victims told a deputy they were having a disagreement over whether the female victim should leave in her vehicle when Myers and Dalton came onto the property, according to the sheriff’s office report.

The male victim said he was standing on his front porch when he was struck in the face by Dalton, who he described as having a bald head and no shirt on. He said after striking him, Dalton started following the female victim as she was walking away from the location. The male victim said while he was on the phone with 911, the front window of his residence was broken by an object that was later discovered to be a kitchen knife, the report said.

The male also said while he was standing on his porch, Myers had a large Stanley brand level, which belonged to the victim, in his hands and was threatening him with it. The victim said he was in fear of being attacked. He said Myers eventually dropped the level, causing $60 in damage to it, according to the report.

The female victim, who had a laceration and swelling over and around her left eye, said the two men were following her in the roadway in front of the house and she felt threatened. She said as they got closer, she threw a beer can at one of them in self-defense and then was struck above her eye. The female victim said she couldn’t recall who struck her or who she threw the beer can at, the report said.

The male victim showed the deputy surveillance video of the location, which showed Dalton walking up the stairs onto the front porch and punching the male victim in the face with his right fist. Later in the video, Dalton is seen crouching down by the rear passenger tire of the victim’s Chevy truck. Dalton then walked across the front yard and threw the kitchen knife at the front window of the home, causing about $200 in damage. It was later discovered the tire on the victim’s vehicle was cut, causing $320 in damage, according to the report.

The video also shows Myers holding the level in the aggressive manner described by the male victim. Later in the video, the female victim is seen walking in the roadway with Myers and Dalton following her. She then threw the beer can at Dalton in self-defense, and Myers struck her in the face, the injury, the report said.

When Myers was taken into custody, a container containing a leafy substance was found in his front-right pants pocket. The substance tested positive for marijuana. There were also two metal pipes causing in his pocket with residue that also tested positive for marijuana, according to the report.

Both Myers and Dalton denied the allegations. A criminal history check shows Myers was convicted of battery on a law enforcement officer and battery (second offense) in 2003 in Pinellas County, the report said.

Both men were taken to the Marion County Jail. Myers was released Sunday on 6,500 bond and Dalton was released Sunday on $4,000 bond. No court information was available.
