A Fort McCoy woman who said she had two glasses of Merlot wine at the Latinos Y Mas Mexican restaurant in Ocala was charged with DUI after being pulled over last week in Silver Springs.
Diane Harvey McDonald, 60, of 13471 NE 226 Avenue Road, was behind the wheel of a vehicle that a Marion County sheriff’s deputy observed traveling eastbound on East Highway 40 at about 40 mph in a 55-mph zone. The deputy initiated a traffic stop in the 8500 block of East Highway 40, according to the sheriff’s office report.
While speaking to McDonald, the deputy observed a “to-go” food container turned over in the center console. Her speech was slurred, and she was unable to find her driver’s license. After confirming her identity through the Driver and Vehicle Identification Database (DAVID), the deputy asked McDonald if she had anything to drink and she replied, “two glasses of wine,” the report said.
McDonald failed a series of field sobriety exercises and was taken to the Marion County Jail, where a breath test came back with readings of .151 and .155. After being read her Miranda rights, McDonald said she was coming from Latino Y Mas with a friend. She admitted to having too much to drink, according to the report.
McDonald said she consumed two glasses of Merlot wine. She said she arrived at the restaurant at around 6:15 p.m. and was there about two hours. When asked what time she thought it was, she said “about 9:30?” It was actually 11:17 p.m. the report said.
McDonald was released the next day on $1,000 bond and will appear in Marion County Court on Sept. 30.
