Ocala man jailed a third time on battery charge

An Ocala man convicted of battering a pregnant woman last year and charged with battery again this year landed back behind bars after being caught on video striking another person.

Gilberto Martinez, 26, of 1120 NW 118th Terrace, was charged with battery (second or subsequent offense) after the incident, which happened Sunday evening at a residence on NW 112th Street. The victim’s name and gender were redacted from the Marion County Sheriff’s Office report.

Martinez was charged in March 2019 and convicted in August 2019 of aggravated battery of a pregnant victim. He was charged in May with battery (second or subsequent offense) and violating his probation.

A sheriff’s deputy responded to the incident location and spoke with Martinez’s girlfriend and mother of his baby. She said Martinez came to the gate of the residence and was there to harm the victim, according to the report.

Martinez’s girlfriend recorded the incident on her cell phone. The video clearly showed Martinez approaching the victim with balled-up fists. He can be heard saying, “I want to kick your ass,” to the victim, the report said.

In the video, Martinez then takes his balled-up fists and swings at the victim’s face. The victim moved back and blocked the swings. Martinez then hit the victim’s right forearm and left the incident location, according to the report.

Martinez was later found at a residence on NW 10th Street and placed under arrest. He was released Tuesday from the Marion County Jail on $2,000 bond and will appear in Marion County Court on Oct. 13.
