Drunk Ocklawaha bicyclist makes lewd remark to deputy

An Ocklawaha man reportedly told a Marion County sheriff’s deputy to perform a sex act on him when asked to provide a breath sample while being arrested for riding his bicycle while drunk.

Eric Nolan McNew, 55, was charged Oct. 28 with DUI (third or subsequent violation in 10 years). He has previous DUI convictions in Ohio in 1988 and 1990 in Volusia County.

The deputy responded to the 6600 block of NE 6th Place after a concerned citizen reported a man sitting in a ditch, drinking a beer, who appeared to be intoxicated and passed out. The deputy walked to the back yard of the property and saw McNew riding a green bicycle westbound on NE 7th Street, according to the sheriff’s office report.

The deputy left the neighborhood in his patrol, turning eastbound onto NE 7th Street, and saw McNew traveling westbound in the middle of the eastbound lane. McNew then swerved on his bicycle, almost falling. The deputy stopped him in the 6600 block of NE 7th Street, the report said.

The deputy observed McNew had bloodshot, watery eyes and his speech was mumbled. He had alcohol on his breath.  McNew agreed to perform a series of field sobriety tests, but after failing the horizontal gaze nystagmus test, he refused to finish and asked to just be taken to jail, according to the report.

McNew was placed under arrested and taken to the Marion County Jail without incident. When asked at the jail to provide a breath sample for testing, he told the deputy, “Suck my (expletive deleted).” The report said.

McNew is being held on $2,000 bond and is scheduled to appear in Marion County Court on Nov. 25.
