Silver Springs man accused of biting elderly woman in spat

A 48-year-old Silver Springs man was arrested after he allegedly bit an elderly woman during a domestic spat last week.

Jason Ashley Mayhew was charged with domestic battery on a person 65 years of age or older after the incident, which happened Thursday evening at the residence where he has lived with the victim since April. The relationship between Mayhew and the victim was redacted from the Marion County Sheriff’s Office report.

The victim told a sheriff’s deputy Mayhew was upset when he returned home from work and they got into an argument. She said he started calling her names and threatened to get her fired from her job. The victim said she asked Mayhew to leave and he responded by saying he would beat her, according to the report.

The victim said she was going to have to call someone to make him leave and Mayhew said he would kill her before the cops arrived. She said he picked up a wooden dog gate, held it out in front of him and moved quickly towards her but stopped before hitting her with it, the report said.

The victim said Mayhew was physically shaking and said he wanted to beat her so badly. She said he said, “You don’t now how bad I want to do it.” The victim said as he removed the gate from in front of her, it caused her to spill a soda can she was holding on him. She said Mayhew started yelling and demanded she give him the phone she was holding in her other hand, according to the report.

The victim said Mayhew lunged for the phone and as she moved her arm out of his reach, he lost his balance and, while falling forward, pressed against her and caused her to fall backwards into a chair. She said Mayhew then tried to get her to drop her phone by biting her right wrist just below the palm near her pinky, the report said.

The victim said she slapped Mayhew in the chin with an open hand and he got up. She said as she was trying to get away, he pushed against her with his shoulder and she pushed him away. The victim said she was able to get outside and call 911 while Mayhew retreated to his bedroom, according to the report.

The deputy observed teeth marks on the victim’s right wrist that were red and swollen but did not appear to break the skin. The victim provided a sworn statement and refused medical treatment, the report said.

After being advised of his Miranda rights, Mayhew said he and the victim argued but claimed there was no physical contact at any time during the incident. Based on the corroboration between the victim’s statement and the injuries observed, as well as the fear of future violence, Mayhew was determined to be the primary aggressor and placed under arrest, according to the report.

Mayhew is being held in the Marion County Jail on $5,000 bond and is scheduled to appear in Marion County Court on Jan. 19, 2021.
