Silver Springs man popped for DUI claims he only had two beers

A Silver Springs man who claimed he had only two beers was nearly three times the legal limit during his DUI arrest Monday night.

Ralph Leroy Weibley Jr., 41, was charged with DUI with a blood-alcohol level of .15 or higher and operating a motor vehicle without a license after being pulled over at around 11 p.m. for going 77 mph in a 55-mph zone in the 17500 block of East Highway 40.

A Marion County sheriff’s deputy observed Weibley make a right turn northbound onto SE 170th Avenue with a wide radius and into the opposite lane before the traffic stop. The deputy spoke with Weibley, who said he was on his way home from work, according to the sheriff’s office report.

The deputy smelled the odor of alcohol on Weibley’s breath as he spoke. Weibley’s speech was mumbled. Asked how much he had to drink, he said two beers. Weibley failed a series of field sobriety exercises and was taken to the Marion County Jail, the report said.

At the jail, Weibley provided breath samples that measured .210 and .226 grams of alcohol per 210 liters of breath. During the traffic stop, Weibley handed the deputy a Florida ID card and said he doesn’t have a records check. A records check showed Weibley’s license was canceled in October 2019.

Weibley was released Tuesday on $1,500 bond and is scheduled to appear in Marion County Court on Feb. 9.
