Stumbling Louisiana man urinates on himself after DUI arrest

A Louisiana man urinated in his pants at the Marion County Jail after being arrested on a DUI charge outside an Ocala Taco Bell on Tuesday night.

An Ocala Police officer responded around 9 p.m. to the restaurant, located at 2116 E. Silver Springs Blvd., after receiving a witness report of a grey Ford Escape driving recklessly. The officer found 38-year-old Erick G. Hernandez, of Terrytown, La., in the driver’s seat a few feet from the stop sign at the parking lot exit, according to the police report.

The vehicle was in drive and Hernandez appeared to be confused when asked to put the vehicle in park and shut off the ignition. He continued to look around and said he was leaving. The officer placed the car in park, turned it off and took away the keys, the report said.

Hernandez was taken out of the driver’s seat. As he stepped out of the vehicle, the officer observed him stumbling around as if he was impaired. Hernandez could not stand on his own but instead leaned against the vehicle during the investigation. His eyes were glassy red, and he couldn’t focus on what was being asked. The officer noticed the odor of alcohol on his breath as he began to talk, according to the report.

When asked, Hernandez said he was not having a medical emergency, did not have any medical conditions that affected his driving, and he had not taken any medications that would affect his driving, the report said.

After being read his Miranda warning, Hernandez said he didn’t want to speak with the officer and refused to participate in field sobriety exercises and did not consent to a breath or blood test. After being placed under arrest for driving under the influence, Hernandez stumbled while being escorted to the patrol car and had to be held up so he didn’t fall to the ground, according to the report.

The witness who called police about Hernandez said he was sitting in the median on East Silver Springs Boulevard when he saw Hernandez stopped in the middle of traffic in front of Taco Bell. The witness said when traffic started to approach Hernandez, he rapidly accelerated and hit the curb before pulling into Taco Bell. He said Hernadez almost struck the building and another vehicle in the drive-through, the report said.

The officer called for EMS, who responded and evaluated Hernandez, and a tow truck to remove his vehicle. During an inventory search, the officer found Hernandez’s wallet with his Louisiana ID card, according to the report.

At the jail, Hernandez was removing his shoes when he fell into the wall and used the top of his head to keep his balance while he selected sandals. While waiting for jail staff to begin the booking process, he said he had to go to the bathroom. The officer told Hernandez he needed to wait for the staff to allow him to use the facilities. Hernandez said he could not hold it, walked to the wall, and urinated in his own shorts, the report said.

In addition to DUI, Hernandez was charged with not having a valid license. He’s being held on $11,000 bond and will appear in Marion County Court on June 10.
