An Ocala man was charged with battery on an elderly person after a woman reported he shoved her after she picked up his dog.
On July 11, a Marion County Sheriff’s deputy responded to a victim who reported an alleged harassment concern.
The victim claimed 68-year-old James Smith came to her home asking for her. The victim stated she did not want to come out because Smith has a temper and she was afraid of him, according to the sheriff’s report.
The victim then went on to report an incident on May 25 when she was living with Smith at his home, and they got into an argument over her leaving.
The victim claims when she went to pick up Smith’s dog, he grabbed the dog out of her hands and shoved her out of the room. The victim said she waited to report the incident because she was in fear, according to the report.
Smith claims he never touched the victim but admitted to shutting a door on her, the report stated.
According to the report, based on the victim’s age, the domestic nature of the call, fear of future violence from the victim and the victim’s signed sworn written statement, Smith was arrested.
Smith was transported to the Marion County Jail with a bond set at $500. He was released on July 12. He was charged with battery on a person 65 years of age or older and a court date is set for August 10 at 9 a.m., jail records show.
