A local pool company is suing two clients for allegedly writing bad checks and skipping out on payments for pools that were delivered “in good faith.”
Tranquil Waters, Inc., which does business as Family Pool, Spa & Billiard Center, filed two cases in Marion County small claims court on Wednesday, November 8.
In the first case, the company says that on September 6, 2021, Cesar Quiñones, of Kissimmee, issued two checks totaling $8,559 in exchange for a pool.
The company alleges that Quiñones took the pool with him after issuing the checks. Sometime thereafter, the business says it discovered that “both checks were written incorrectly.”
According to the pool center, Quiñones wrote “different amounts in the numeral block” than what was specified “in words.”
“Both of these checks were sent back unpaid,” according to the complaint.
The company says it sent multiple emails and that Quiñones promised “to pay” before sending a check. That check came back as “being written on a closed account,” according to the complaint.
In a separate case, the business claims that Candice and Jerek Jackson, of Dunnellon, purchased an above-ground pool package for $9,306.86 on March 27, 2023.
The company says that it allowed the couple to “pay for the pool in installments” in an act of “good faith.”
“They put $5,000 down and the amount to be withdrawn from their credit card monthly” was $281.53, according to the complaint. The company says that the payments were to be withdrawn “until paid in full.”
According to Tranquil Waters, the couple received the pool on April 6, 2023, and the company received a payment for $281.53 in May. Since then, the business says “all other payments have been declined.”
“We have reached out many times for payment, but none have been made,” reads the complaint.
In total, the company says that the customers owe $13,200.20, with Quiñones owing $8,000 and the Jacksons owing $5,200.20.
