Ocala man accused of choking girlfriend after she refused to share marijuana

A 29-year-old Ocala man is facing a felony battery charge after he allegedly choked his girlfriend during an argument over her marijuana.

On Sunday, June 23, a Marion County Sheriff’s Office corporal and deputy responded to a local residence after a neighbor reported hearing a physical altercation. Upon arrival, they made contact with a man identified as Erick Cue, according to the arrest report.

Cue stated that he had gotten into an argument with his girlfriend, identified in the report as the victim, over her “weed.” He stated that the victim was smoking marijuana outside, and she “would not share (it) with him.”

According to Cue’s statement, he attempted to get marijuana from a nearby table when the victim grabbed his hand. He further claimed that the victim then grabbed him by the shirt and pulled him to the floor. During the altercation, he stated that the victim smashed her own cellphone.

The corporal made contact with the victim who gave a similar recollection of the events leading to the altercation. She stated that Cue “does not have a medical marijuana card like she does,” according to the report.

The victim stated that Cue snatched a bag of marijuana from her hand after she told him that he could not have any of it. Moments later, the victim stated that she began recording a video of the incident on her cellphone.

During the incident, the victim alleged that Cue “took her to the ground” and began choking her with his arm and hands. He then allegedly smashed her cellphone on the floor to “get rid of the video” she had recorded.

The corporal noted in the report that the victim had red marks around her neck that were consistent with being choked.

After being read his Miranda rights, Cue admitted that he did not have a medical marijuana card, and he stated that he had tried to grab some of the victim’s marijuana. However, Cue denied choking the victim and claimed that the incident never got physical.

Cue was arrested and transported to Marion County Jail on Sunday. Three days later, he was released after posting a $2,500 bond. He is being charged with domestic battery by strangulation.

A court date has been scheduled at 9 a.m. on Tuesday, July 23, according to jail records.
