A 33-year-old Ocala man with a prior domestic battery conviction was arrested after he allegedly punched his brother while attempting to assist with an oil change.

On Tuesday, August 27, a Marion County Sheriff’s Office deputy responded to a local residence in reference to a domestic dispute. When the deputy arrived, three individuals – two men and a woman – were standing in the roadway, and the two men appeared to be yelling at each other, according to the arrest report.

One of the men, identified as Jeremy Austin Wise, appeared to be “visibly agitated” as he began walking away from the incident location. The deputy made contact with Wise and observed that his right arm and shoulder appeared to be covered in motor oil.

After instructing Wise to wait by the MCSO patrol vehicle, the deputy made contact with the male victim and his female friend. The victim stated that his friend had come to the residence to have her oil changed, according to the report.

While the victim was changing the oil, he stated that his brother, Wise, approached the vehicle and started helping. According to the victim’s statement, he did not ask Wise for help, and an argument ensued when Wise refused to leave.

As Wise and the victim were arguing, the victim’s friend positioned herself between them in an attempt to diffuse the situation. The victim alleged that Wise “reached over (his friend) and punched him in the right cheek,” according to the report.

The deputy noted that the victim had a red mark on his right cheek that was “consistent with being punched in the face.” According to the report, the victim’s friend spoke with the deputy and corroborated the victim’s statement.

Wise was placed under arrest, and a pat-down search was conducted. The report stated that two glass pipes and a small container were found in his pocket, and they contained a bluish-white powdery substance that field-tested positive for fentanyl.

In the report, the deputy mentioned that while Wise was being led to the patrol vehicle at the incident location, he allegedly yelled at the victim, “When I get out of jail, I’m gonna beat your b**** a**, how about that?” Wise also allegedly yelled that the victim was “dead” and that he “better not be in Florida.”

Shortly after being transported to Marion County Jail, Wise was read his Miranda rights. He agreed to discuss the incident and claimed that he had punched the victim in the face because the victim “called him a p****,” according to the report.

During the post-Miranda interview, Wise claimed that the victim had stabbed him in the neck with a screwdriver during the incident. However, several witnesses at the scene told the deputy that the victim did not stab Wise.

A criminal history search of Wise revealed that he was convicted of domestic battery in Marion County on July 29, 2024.

Wise is currently being held at Marion County Jail without bond. He is being charged with battery (second or subsequent offense), possession of fentanyl, and possession of drug paraphernalia.

A court date has not been scheduled yet, according to jail records.
