An Ocala man charged with DUI earlier this month was arrested Monday after a fight with a woman who was trying to keep him from driving drunk again.
Drake Christian Pagan, 22, was charged with simple domestic battery after the incident, which happened at his residence at 823 NE 35th St. He was previously arrested and charged with DUI on June 6.
A Marion County sheriff’s deputy responded to Pagan’s home and noted he appeared to be under the influence of alcohol. Pagan said he and the victim were arguing because she wouldn’t get out of his vehicle. He said at one point, he placed both of his hands on the victim’s knees and she hit him with the car keys, causing a small cut on his right cheek, according to the sheriff’s office report.
The victim said Pagan called her and asked her to come to his residence earlier in the day. She said he was extremely intoxicated when she arrived. The victim said she and Pagan got into an argument because he said he was going to drive away in his truck. She said he placed the keys in the ignition and then walked back inside his residence, the report said.
The victim said because Pagan was arrested for DUI the previous week, she was afraid he was going to hurt himself or someone else. She said she got inside Pagan’s vehicle and took the keys back out of the ignition. The victim said Pagan came back out to his truck, grabbed her by her legs and dragged her out of the vehicle, according to the report.
The victim said Pagan wouldn’t let her go and she hit him in the face in an effort to get away. The deputy observed an abrasion on the victim’s left thigh that was consistent with being pulled out of the vehicle, the report said.
Pagan’s mother, who reported the incident, said she witnessed the altercation and corroborated the victim’s story. After being read his Miranda warning, Pagan said he didn’t want to speak to the deputy. He later spontaneously said the victim was only looking out for him and didn’t want him to drive.
Pagan was taken to the Marion County Jail, where he was being held on $10,000 bond. He is scheduled to appear in Marion County Court on July 8.
