Passed-out homeless man caught with drugs, guns and money in vehicle

A 22-year-old man who’s already served a few stints in the Marion County Jail was arrested after drugs, guns and money were found in his vehicle with him passed out and blocking traffic on SE Abshier Boulevard in Belleview on Sunday afternoon.

Joseph Darius Delvin Jackson, who is listed as homeless in the Belleview Police arrest affidavit, was charged with armed trafficking in methamphetamine, DUI, driving with a suspended license, possession of Oxycodone Hydrochloride without a prescription, and possession of Alprazolam without a prescription.

Jackson has been arrested a handful of time since July 2017, when he was jailed for 90 days after resisting an officer without violence and grand theft of a motor vehicle. He spent five months behind bars in 2018 for loitering or prowling and a probation violation, and he was sentenced to six months in jail after an October 2019 incident in which a K-9 unit tracked him down when he got away from deputies arresting him on numerous drug charges.

A Belleview Police officer responded around 5:18 p.m. Sunday to the 5700 block of SE Abshier Boulevard, where a caller had reported a red car appeared to be disabled in the road and was blocking traffic. The officer observed a red Hyundai was stopped in the outside southbound lane at the intersection with SE Highway 484. An anonymous passerby said the man behind the wheel was passed out, according to the police report.

The driver – later identified as Jackson – was leaned back in the driver’s seat, seemingly asleep. The officer tried to open the door to put the car into park but it was locked, so he knocked on the window and awakened Jackson, who took his foot off the brake pedal, causing the car to roll forward into the intersection. The officer yelled for Jackson to stop the vehicle and he did, the report said.

The officer ordered Jackson to open the door and when he did, the officer immediately noticed the strong and distinct odor of marijuana coming from the vehicle. Asked how much marijuana he had smoked, Jackson said he did smoke some but there wasn’t any left in the vehicle. Jackson told the officer he might find some marijuana in the ash tray, according to the report.

The officer patted-down Jackson but didn’t find anything illegal. He observed Jackson’s eyes were glassy and bloodshot and his speech was slurred, mumbled and thick-tongued. When asked for his driver’s license, Jackson said it was suspended. He was handcuffed and put in the back seat of the patrol vehicle, the report said.

Officers searched Jackson’s vehicle and found a wallet containing a large amount of cash and a credit card with Jackson’s name in the center console area, along with a silver cup that had used cigarettes, ash and green residue that appeared to be from a marijuana cigarette. Found on the floor of the vehicle was a pill bottle containing two different types of pills, and inside the glove box was an orange aluminum container with multiple clear plastic bags containing an opaque crystal-like substance that appeared to be methamphetamine, according to the report.

An officer observed a handgun holster on the passenger floorboard and another officer found two loaded and chambered handguns underneath the front passenger seat. One handgun was a Smith and Wesson 9mm, while the other was a Glock .45 caliber. Also on the floorboard was a purse containing a large amount of cash, the report said.

The crystal substance tested positive for methamphetamine. The blue pills that were found were identified as Alprazolam extended release, while the green pills were identified as Oxycodone Hydrochloride. There was $683 in the wallet and $603 in the purse for a total of $1,286 in cash. A records check showed the Smith and Wesson handgun was reported stolen out of Lake County, according to the report.

Jackson was taken to the jail, where he failed a series of field sobriety exercises. After a breathalyzer test returned two readings of 0.00, a drug recognition expert evaluated Jackson and determined he was under the influence of a drug and unable to safely operate a vehicle. Jackson refused to provide a urine sample for testing, the report said.

Jackson was released from jail Wednesday on $35,500 bond and will answer to the charges in Marion County Court on Feb. 23.
