Man struck with hammer, held at gunpoint after breaking into Marion couple’s home

The Marion County Sheriff’s Office arrested a 41-year-old Ocala man after a married couple accused him of breaking into their home.

On Sunday, June 11, an MCSO corporal responded to a residence located in the 23500 block of SW Rainbow Lakes Boulevard in Dunnellon in reference to a burglary incident. A woman had contacted the sheriff’s office to advise that her husband was holding the male suspect, later identified as Robin Jose Rivera, Jr., at gunpoint, according to the arrest report.

Upon arrival at the incident location, the corporal observed the female victim and her family standing over Rivera in the front yard. The corporal noted in the report that Rivera was “lying face down (and) crying,” and he had “numerous minor bleeding injuries” all over his body.

The corporal detained Rivera in handcuffs and then made contact with both victims. The female victim stated that she was lying in bed next to her husband when she heard “some kind of banging” outside that kept getting louder. She advised that she soon realized that the sound was caused by someone banging on the front door, and she woke her husband up, according to the MCSO report.

After grabbing a single barrel shotgun, the male victim went to the front door and discovered that it had already been knocked off its hinges. The MCSO report stated that Rivera allegedly entered the home, and the male victim pointed the shotgun at Rivera and told him to leave the residence.

Rivera allegedly told the victims that he was “looking for his family.” The male victim threatened to shoot Rivera if he refused to leave the home, and Rivera allegedly stated, “Go ahead, shoot me,” according to the MCSO report.

The victims advised that Rivera attempted to grab the shotgun, and the male victim fell down during the ensuing struggle for the firearm. The female victim told the corporal that she grabbed a wooden hammer and struck Rivera in the head to protect her husband. She advised that Rivera got back up and “began to charge (at) them again,” and she hit him a few more times with the hammer prior to the arrival of law enforcement.

In the MCSO report, the corporal noted that the front door was completely removed from the wall. Multiple small puddles of blood were “all over the area of the living room” where the incident took place. The corporal observed that Rivera was the only person at the scene who was actively bleeding.

The corporal returned to Rivera and noted in the report that he was “highly intoxicated and belligerent.” After being read his Miranda rights, Rivera stated that he was “just trying to get back to his mother-in-law’s house.”

When the corporal informed Rivera that they were not at his mother-in-law’s house, Rivera asked, “I’m not?” The corporal noted in the report that Rivera then began to cry. During the post-Miranda interview, he denied the victims’ allegations that he knocked down the front door and entered their residence.

Rivera was arrested, transported to Marion County Jail, and he was later released on $25,000 bond. He is facing a felony charge for burglary with assault or battery.

A court date has been scheduled at 9 a.m. on Tuesday, July 11, according to jail records.
