A 46-year-old Umatilla man accused of battering a woman is facing additional charges after he allegedly resisted arrest, threatened several law enforcement officers, and damaged a patrol vehicle.
On Monday, several Marion County Sheriff’s Office deputies responded to a local residence in reference to a battery incident that had just recently occurred. Upon arrival, one of the deputies made contact with the female victim who advised that she had been battered by Paul Edward Barbato, Jr., according to the arrest report.
The deputy noted in the report that blood was “oozing” from an injury on the right side of the victim’s head. The victim stated that the injury occurred when Barbato threw an unknown object at her head.
Based on the victim’s statements, the deputy approached Barbato and attempted to detain him. The report stated that Barbato began to resist, and it took several deputies to secure him in handcuffs.
During this interaction, Barbato allegedly became irate and stated that he would have his brothers “merc” the deputies. The term “merc” is slang for “kill,” according to the report.
Once Barbato was in handcuffs, a pat-down search was conducted. The report stated that a glass pipe containing a brown substance was located in his waistband, and the substance later field-tested positive for methamphetamine.
Barbato then began “forcefully (banging) his head” into an MCSO patrol vehicle, leaving a small dent in the vehicle. While being placed into the back of the vehicle, he allegedly screamed at the victim that he “will kill (her),” according to the report.
Once inside the patrol vehicle, the report stated that Barbato repeatedly banged his head against the bars and plexiglass.
The victim spoke with an MCSO deputy and advised that Barbato had kicked her in the face and ribs while inside her bedroom. She had a bloodied lip and “fresh redness” on the left side of her ribs, according to the report.
After leaving the bedroom, she stated that Barbato threw an unknown object that struck her right shoulder. An eyewitness gave a corroborating statement regarding the thrown object.
The report stated that while deputies were on scene, Barbato briefly attempted to flee on foot. He was quickly apprehended and returned to the back of a patrol vehicle, where he “continued to bash his head” against the inside of the vehicle. Deputies then placed Barbato in a hobble restraint to prevent him from harming himself.
Barbato was arrested and transported to a local hospital. After being medically cleared, he was taken to Marion County Jail, where he is currently being held on a $28,000 bond. He is being charged with battery (second or subsequent offense), resisting an officer with violence, resisting an officer without violence, making threats of death or serious bodily harm to a law enforcement officer, possession of drug paraphernalia, and criminal mischief with property damage under $200.
A court date has been scheduled at 9 a.m. on Tuesday, July 16, according to jail records.
