In a lawsuit filed against a Wawa in Ocala, a woman claims she sustained “serious injuries” after she allegedly slipped and fell on a liquid next to the checkout lane.

Attorneys representing Crystal Bagley filed the lawsuit against Wawa Florida, LLC, in the Fifth Judicial Circuit Court of Marion County on August 8.

According to the complaint, Bagley was visiting the Wawa at 4025 SW College Road in Ocala on August 13, 2024.

During her visit, Bagley approached the checkout counter within the gas station to pay for her items. While she was walking near the counter, Bagley claims the “unreasonably dangerous condition” caused her to “slip and fall.”

Bagley’s attorneys argue that Wawa breached its duty to Bagley by “failing to maintain its premises in a reasonably safe condition” and by failing to warn her of the “unreasonably dangerous condition.”

It further claims the company was negligent by failing to ensure that the “ground near the checkout counter” was free of “foreign liquid substances.”

As a result of the fall, Bagley claims she “suffered permanent physical injury and resulting pain and suffering.” The complaint states that Bagley experienced a loss of capacity for the enjoyment of life, hospitalization expenses, medical and nursing care treatment, and a loss of earnings, among other losses.

Bagley is seeking in excess of $50,000 in damages, exclusive of attorney’s costs.
