Man accused of battering 75-year-old mother won’t be prosecuted

A Summerfield man who was arrested in March after an altercation with his mother over drinking will not be prosecuted in the case.

Marion County sheriff’s deputies were dispatched to the home of 46-year-old Jean Philippe Gauthier at SE 175th Place on the afternoon of March 25, where his 75-year-old mother reported that he had struck her in the bottom of her right jaw with his fist. She said they had been arguing about his drinking problem.

Gauthier, who deputies noted was heavily intoxicated, was arrested on a charge of domestic battery on a person 65 or older and transported to the Marion County Jail, where he was held with no bond. Gauthier also was charged with violating his probation on a burglary charge out of Broward County.

Marion County prosecutors made the decision not to move forward with the domestic battery case on July 27 and Gauthier was released from jail two days later. The following day, Broward County Court records show, he was rearrested for violating his probation.

His attorney, Gary S. Ostrow – he is known in South Florida for handling high-profile cases and once represented former Miami Dolphins running back Ricky Williams when he was accused of violating the NFL’s substance-abuse policy – quickly filed a motion to dismiss the charge. A status conference is scheduled for Sept. 13 at 9 a.m.

Gauthier also was arrested on Nov. 25, 2017 on a charge of domestic battery on a person 65 or older. That charge was dropped the following month, Marion County Court records show.
