A 50-year-old Ocala man was arrested for allegedly placing his girlfriend in a chokehold after she refused to have sex.
Early in the morning on Monday, April 7, a Marion County Sheriff’s Office deputy responded to a local residence and made contact with the female victim. She alleged that her boyfriend, Seth Laburda, had “strangled” her, according to the arrest report.
The victim stated that she had been upset with Laburda due to an argument they had engaged in earlier that night. She told the deputy that she was in her bedroom when Laburda entered it, and he tried to have sex with her.
According to the victim’s statement, Laburda had been consuming alcoholic beverages that night, and she refused to have sex with him. This sparked another argument, and Laburda allegedly grabbed the victim by her ankles before pulling her off the bed and pushing her up against the bedroom wall.
The victim further alleged that Laburda wrapped his right arm around her neck, placing her in a chokehold. He then allegedly squeezed the victim’s throat, and she advised that she began to feel dizzy and had difficulty breathing.
When Laburda “loosened his grip,” the victim stated that she bit his right bicep, which caused him to let go of her, according to the report. The deputy noted that the victim also alleged that at some point during the incident, Laburda “threw a television remote at her,” and it struck her left ankle before shattering on the floor.
The report stated that the victim had a small laceration and “fresh blood” on her ankle. No further injuries were mentioned by the deputy in the report.
The deputy made contact with Laburda. After being read his Miranda rights, Laburda stated that the victim bit his right bicep during the incident. The location of the bite mark – in the middle of the inside of Laburda’s bicep – was “consistent with the victim’s statement,” according to the report.
Laburda was arrested and transported to Marion County Jail, where he is currently being held without bond. He is being charged with domestic battery by strangulation.
A court date for Laburda has not been scheduled yet, according to jail records.
