A woman has sued Key Food Supermarket in Ocala for injuries she allegedly sustained after slipping on a “transient substance” while walking through the grocery store.
Attorneys representing Lydia Roldan filed the lawsuit against DJB Food Corporation in the Fifth Judicial Circuit Court of Marion County on June 13.
According to the complaint, Roldan was visiting the grocery store at 1929 SW College Road in southwest Ocala on January 25, 2024.
While Roldan was walking through the store, she allegedly “slipped and fell due to a dangerous condition.” The lawsuit names that condition as a “transient substance on the floor.”
The lawsuit claims that the “hazardous condition was not open and obvious” and that there were “no warnings posted regarding the hazard.”
As a result of the organization’s alleged negligence, Roldan claims that she sustained “bodily injury and resulting pain and suffering, disability disfigurement, mental anguish, loss of capacity for the enjoyment of life, and medical expenses.”
The losses are described as “either permanent or continuing,” and the lawsuit claims Roldan will continue to suffer them “in the future.”
State corporate records show that DJB Food Corporation is owned by Jose and Nancy Batista. On June 18, a summons was filed against the defendant, naming Mr. Batista as the company’s registered agent.
Roldan is represented by Gainesville-based Beacon Legal, PLLC.
