A Marion County man who was watching a concert at a pirate-themed bar in downtown Ocala claims he sustained serious injuries after he was allegedly trampled by two “intoxicated women” who were skipping “arm-in-arm” through the venue and “whose combined weight exceeded several hundred pounds.”

John Westbrook filed the lawsuit against Martin & Weiss, LLC, in the Fifth Judicial Circuit Court of Marion County on August 13.

According to the complaint, Westbrook visited Mutiny Bar Ocala at 46 S Magnolia Avenue on December 11, 2024, to watch a concert performance by the Dirty Rotten Imbeciles (D.R.I.).

State corporate records show that Mutiny Bar Ocala is owned by Martin & Weiss, LLC, which is registered to Buck Martin.

While Westbrook was standing at the bar watching the band, he claims he was “trampled by two females who were running inside the bar.”

The complaint alleges that the bar provided too much alcohol to the women, leading to their alleged drunken state.

“[Mutiny Bar Ocala] breached its duties owed to [John Westbrook] by overserving alcohol to two visibly intoxicated patrons, whose combined weight exceeded several hundred pounds, and by allowing them to run and skip arm-in-arm at high speed through the crowded premises, thereby creating a dangerous condition,” according to the complaint.

Westbrook alleges that the business failed to take reasonable steps to “stop, control, or remove said patrons,” and that it failed to warn him of the “foreseeable hazard.”

As a result of the collision, Westbrook says he sustained “serious personal injuries” and physical impairment.

Westbrook, who is listed as a resident of Marion County in the lawsuit, claims the losses “are permanent and will continue into the future.” He is seeking in excess of $50,000 in damages, exclusive of legal fees. He is represented by the Miami-based Law Office of Irwin Ast.

Mutiny Bar Ocala officially opened its doors in downtown in the fall of 2021. It is situated a couple of doors down from the Marion Theatre, next to its sister bar, Tipsy Skipper.
