A Belleview man who spent a total of 148 days in jail in 2012 and 2015 is asking Marion County officials to forgive a $14,756 incarceration lien that has accrued since then, saying he wants to make amends and clean up his past.
Hugh M. Rioch will present his request for consideration of a reduction or release of his civil restitution lien during Wednesday’s meeting of the Marion County Board of County Commissioners (MCBCC).
Rioch is requesting a reduction of the Civil Restitution/Cost of Incarceration Lien totaling $14,756.24, with $8,997.60 remaining in judgment and $5,758.64 in interest. The costs spawn from two separate jail stays that Rioch had over a decade ago.
In November 2011, Rioch was arrested for driving with a suspended license. In January 2012, he was sentenced to 150 days in jail. He served 124 days in the Marion County Jail and was an inmate worker for approximately 116 of those days.
In July 2015, Rioch was arrested for a battery domestic violence charge, which is classified as a first degree misdemeanor. At the time, Rioch was sentenced to 30 days in jail. He served 24 days and was an inmate worker for 8 days.
In total, Rioch was not an inmate worker for approximately 24 days during his 148 days of incarceration.
After his different stints in the jail, the court imposed incarceration costs of $7,500 and $1,500, respectively. Those costs are calculated by multiplying the number of days in the sentence by $50 each day.
Rioch was sentenced to 180 days, which equates to $9,000. Over the past decade, that amount has accrued additional interest in the amount of $5,758.64, bringing the total to approximately $14,756.24.
In similar cases in the past, the MCBCC has generally forgiven any fees assigned to days served as an inmate worker. In this case, there are only 24 days, accounting for approximately $1,200 in fees, in which Rioch did not work at the jail.
The Marion County Board of County Commissioners next meets on Wednesday, September 3, at 9 a.m. at the McPherson Governmental Complex (601 SE 25th Avenue).
