A woman has sued a Zaxby’s in Marion County for injuries she sustained after she allegedly slipped on a “dangerous rug” placed in front of a restroom at the restaurant.
Attorneys representing Laura Zappa filed the lawsuit against Swamp Dawg, LLC, which does business as Zaxby’s Chicken Fingers and Buffalo Wings, in the Fifth Judicial Circuit Court of Marion County on October 6.
According to the complaint, Zappa was visiting the Zaxby’s located at 10560 SE U.S. Highway 441 in Belleview on October 24, 2023.
During her visit, Zappa claims that she attempted to enter the restroom at the restaurant and “slipped and fell on a wet, slippery and dangerous rug placed in front of the restroom entrance.”
The slip caused her to “fall and sustain injuries,” according to the complaint. Zappa’s attorneys argue that the restaurant failed to properly maintain its floors in a “safe and dry manner, thereby creating a hazardous and dangerous condition.” They also accuse Zaxby’s of failing to place safety devices around the area to warn individuals of the wet surface.
As a result of the incident, Zappa claims she suffered bodily injury, hospital expenses, a loss of earnings, a loss of ability to earn money, and several other damages, according to the complaint.
The language used in the complaint to describe Zappa’s injuries and damages is the same type of language used by most attorneys in slip-and-fall lawsuits.
Zappa is seeking in excess of $50,000, exclusive of legal fees and costs.
