A delivery driver has filed a lawsuit against Circle K Stores, Inc. after he was allegedly injured when broken metal shelving collapsed on him while he was unloading merchandise in Ocala.

Antonio Curbeam filed the complaint on May 4 in the Fifth Judicial Circuit Court of Marion County following the alleged incident on September 2, 2024.

Curbeam, an employee of Coca-Cola Beverages Florida LLC, was working inside the drink cooler at the Circle K located at 4605 SE Maricamp Road at the time of the alleged accident.

According to the lawsuit, Curbeam was unloading soft drinks when the shelving unit gave way and fell on him.

The filing states that Curbeam had no knowledge that the shelving was broken prior to the collapse and could do nothing to avoid the falling metal.

Curbeam’s legal team alleges that Circle K was negligent by allowing the broken shelving to exist and failing to warn invitees of the hazard.

The suit contends the store knew or should have known the shelving was in a dangerous state.

The lawsuit claims Curbeam suffered bodily injuries resulting in pain and suffering, disability, and a loss of the ability to earn money. He is seeking damages in excess of $50,000 and has demanded a jury trial.
