An Ocala man claims he was allegedly struck and injured by a “heavy cart” being operated by an employee at an old Winn Dixie that has since been converted into an ALDI.
Attorneys representing Rajiv Ghameersingh filed the lawsuit against Southeastern Grocers, LLC, in the Fifth Judicial Circuit Court of Marion County on September 3.
According to the complaint, Ghameersingh was visiting the Winn-Dixie grocery store located at 184 Marion Oaks Boulevard in Ocala, on September 3, 2023.
During his visit, Ghameersingh claims he was “struck by a heavy cart” that was being operated by an employee, causing him to “sustain serious injuries.”
Ghameersingh alleges that the employee was negligent while performing their job duties. He accuses the business of negligently allowing the employee to “operate heavy equipment in an unsafe manner to patrons.”
Ghameersingh’s attorneys claim Winn-Dixie failed to maintain a proper “lookout and control” of the equipment to avoid potential incidents. They accuse the company of failing to properly train, supervise, or instruct the employee in the “safe operation of equipment” and failing to warn patrons of the “foreseeable risk of being struck by carts being maneuvered within the store.”
The complaint further alleges that Ghameersingh did not “act or omit to act” in any way that would contribute to the incident that caused the injuries.
As a result of the incident, Ghameersingh claims he sustained bodily injuries that include “inconvenience, pain and suffering, mental anguish, loss of capacity for the enjoyment of life, and medical expenses.”
Ghameersingh is seeking over $50,000 in damages, exclusive of attorney’s fees. He is represented by The Good Lawyers, PLLC, an Orlando-based law firm.
