Marion man gets 2 years behind bars, house arrest for possessing child porn

A 39-year-old Marion County man has been sentenced to two years in federal prison and six years of house arrest after being convicted of possessing child pornography.

In January of 2022, the Marion County Sheriff’s Office received a cyber tip from the National Center for Missing and Exploited Children stating that an Internet Protocol (IP) address belonging to Brandon Allen Elledge had uploaded a file containing child pornography to his Google account, according to the arrest report.

On January 18, 2022, a search warrant was issued for the Google account in question, and Elledge was notified that his account was under investigation, per the company’s policy.

Approximately three weeks later, an MCSO detective received 8,885 files that were stored on Elledge’s Google account. According to the report, 39 of those files contained child pornography.

Several MCSO detectives visited Elledge for an interview. Elledge stated that he had lived at the residence for several years, and his wife and children were the only other full-time residents.

While speaking with detectives, Elledge advised that his two primary electronic devices were his cellphone and his laptop, which was located inside his workshop at the residence. According to Elledge’s statement, the home also had a desktop computer that was used by everyone in the household.

During questioning, Elledge admitted that the Google account in question belonged to him. He also admitted to downloading files of child pornography, and he stated that he had attempted to delete all the files he had stored on the devices at the residence. He thought those files had also been deleted from his Google account, according to the report.

A detective noted in the report that Elledge also took his oldest daughter’s cellphone and had utilized the device to download files of child pornography, which were then uploaded to his Google account.

Elledge was arrested and transported to Marion County Jail on February 22, 2022. His case eventually went to trial on May 29, 2024, and a Marion County jury found him guilty of three counts of possessing 10 or more images of child pornography.

In addition, jurors found Elledge not guilty of 16 counts of the same charge.

Last week, the presiding judge, Lisa Diane Herndon, sentenced Elledge to two years in prison, with credit for 464 days already served. Once released from prison, Elledge will spend six years under house arrest, and he will be required to register as a sexual offender.

In April of 2023, Elledge was arrested on separate charges after a juvenile victim disclosed that he had allegedly sexually battered her “numerous times” over a six-year period. According to Marion County Court records, this case is scheduled to go to trial in September of 2024.
