A dispute over loud music led to the arrest of a 74-year-old Ocklawaha man after he was accused of threatening one of his neighbors with a shotgun.
On Thursday, a Marion County Sherif’s Office deputy responded to a residence located on SE 95th Street Road in Ocklawaha in reference to an incident involving a firearm. Upon arrival, a male victim told the deputy that the incident occurred while he was working on several vehicles on his property, which shares a fence line with his neighbor, Harold Eugene Kyzer, according to the arrest report.
The victim advised that he was listening to music from a nearby truck’s radio when Kyzer approached him while wielding a pump-action shotgun. The report stated that Kyzer then allegedly pumped the shotgun several times and screamed at the victim to “turn the music off or else.”
Since the incident was “not worth dying over,” the victim told the deputy that he ran to the truck and quickly turned the music off. The deputy noted in the report that a witness captured a photo of Kyzer, which showed him standing at the property line with a shotgun in his hands.
The deputy made contact with Kyzer at his residence. After being read his Miranda rights, Kyzer stated that he brought a shotgun with him to confront the victim about the loud music because he “wanted (the victim) to know I was serious.”
Kyzer was arrested and transported to Marion County Jail. He was released the following day after posting a $5,000 bond, and he is being charged with aggravated battery with a deadly weapon.
A court date has not been scheduled yet, according to jail records.
