A woman claims she was seriously injured after she allegedly tripped and fell in a hole while she was walking around a restaurant next to the Rainbow River.

Attorneys representing Rose Arias filed the lawsuit in the Fifth Judicial Circuit Court of Marion County against Swampy’s Bar & Grille in Dunnellon on September 12.

According to the complaint, Arias was visiting the restaurant at 19773 E. Pennsylvania Avenue in Dunnellon on March 25, 2024.

During her visit, Arias claims she was walking in an “ordinary, customary, and foreseeable manner” on the premises near the water outside of the facility.

While she was walking, Arias allegedly “tripped and fell in a hole, causing serious injury.”

Arias’ attorneys accuse the restaurant of negligently maintaining the area where the alleged accident occurred. They claim that the restaurant was aware of the alleged hazardous condition and neither their client nor other patrons of the restaurant were warned of the “danger of the hole in the ground.”

As a result of the incident, Arias claims she suffered permanent bodily injuries and that she has sustained heavy financial losses. She claims those losses are either permanent or continuing in nature.

Arias is seeking in excess of $50,000 in damages, exclusive of attorney’s fees and costs. She is represented by Orlando-based law firm Kaufman & Lynd, PLLC.
