An Ocala woman has filed a lawsuit against The Market of Marion, alleging she suffered permanent injuries after slipping on dog feces while visiting the popular flea market.
Attorneys representing Linda Maloney filed the lawsuit against The Market of Marion, Inc., on April 29, in the Fifth Judicial Circuit Court of Marion County.
The lawsuit stems from an incident that allegedly occurred on January 9 of this year. According to the filing, Maloney was visiting the facility, which is located at 12888 U.S. Hwy 441 in Belleview, when she encountered a slippery substance on the interior flooring. The lawsuit states the substance was believed to be dog feces.
Maloney alleges that the market was negligent in its maintenance of the facility. She contends that the facility failed to timely inspect the floors, utilized improper cleaning procedures that resulted in a slippery surface, and failed to follow its own internal safety policies and procedures.
Furthermore, Maloney’s attorneys assert that the dangerous condition was either created by the market, known to staff, or had existed long enough that the business should have discovered and remediated it before the fall occurred.
As a result of the alleged fall, Maloney claims she suffered serious bodily injuries to her extremities and other parts of her body. Maloney is also seeking reimbursement for hospitalization and ongoing medical and nursing care expenses.
The lawsuit seeks damages in excess of $50,000 for pain and suffering, disability, disfigurement, permanent scarring, mental anguish, and loss of capacity for the enjoyment of life.
