A Marion County woman has filed a civil lawsuit against Dollar General, claiming she was injured after tripping over discarded shelving components left on the floor of a local store.
Attorneys representing Jeannie Rodriguez filed the complaint against Dolgencorp, LLC, in the Fifth Judicial Circuit Court of Marion County on Friday, June 19.
The lawsuit stems from an event that allegedly occurred on June 30, 2024, at the Dollar General store located at 16630 US Highway 301 in Summerfield.
According to the filing, Rodriguez was at the retail location when she tripped and fell due to shelf guards and other shelving components that had been left discarded on the floor.
The complaint accuses Dollar General of breaching its duty to maintain a reasonably safe shopping environment for its customers. It alleges that the company failed to inspect the premises, allowed dangerous tripping hazards to remain on the sales floor for an unreasonable length of time, and failed to warn shoppers of the potential danger.
The filing further claims that the store had actual or constructive notice of the condition before the fall occurred.
As a result of the fall, the complaint alleges that Rodriguez suffered bodily injury, physical pain and suffering, disability, disfigurement, mental anguish, a loss of capacity for the enjoyment of life, and the aggravation of a previously existing condition.
The lawsuit further states that she has incurred expenses for hospitalization and medical care, suffered a loss of earnings, and expects these losses to be permanent or continuing in nature.
Rodriguez has requested a trial by jury to resolve the matter and is seeking in excess of $50,000 for injuries sustained during the incident.
