Ocala man jailed after claiming he didn’t believe ‘no meant no’

An Ocala man who says he didn’t believe “no meant no” is behind bars after being charged with domestic sexual battery.

Ocala Police officers were called to a home in the area of NE 22nd Avenue on Sunday night and when they arrived, 33-year-old Frank Joseph Mazzacane was waiting outside the residence. He told officers that he and his girlfriend of one year had been watching television in bed when he attempted to have sexual relations with her, a police report states.

Mazzacane told officers that he grabbed his girlfriend’s arms and pinned them near her head and she started crying and told him to stop multiple times. And he said that he didn’t believe she meant it when she said no, the report says.

The victim confirmed Mazzacane’s story, adding that she was crying and yelling for him to stop. She claimed that he threatened to rape her. And she said he wouldn’t get off of her until her young daughter suddenly entered the room because she heard her mother crying, the report says.

Officers then spoke with Mazzacane again and asked him why he didn’t stop when the victim was crying and told him to do so. He said, “I didn’t think she meant it,” the report says, adding that Mazzacane “even got out of his chair and displayed on the ground what he had done” with the victim during the incident.

The officer notified the Department of Children and Families because the victim’s daughter had witnessed the incident and an operator said the agency would accept the report for further investigation, the report says.

Mazzacane was booked into the Marion County Jail shortly after midnight on Monday morning and is being held on $10,000 bond. He is due in court on June 4 at 9 a.m. to answer to the charge.
