A woman claims she lost her balance, fell, and sustained serious injuries at a Winn-Dixie in Belleview after a wheel on her shopping cart allegedly jammed.

Janelle McMillan filed the lawsuit against Winn-Dixie Stores, LLC., in the Fifth Judicial Circuit Court of Marion county on November 24.

According to the complaint, McMillan was visiting the Winn-Dixie located at 11310 SE Nathan Mayo Highway in Belleview on September 22.

During her visit, McMillan claims she was using a shopping cart and “walking towards the checkout area” when the cart wheel “suddenly and unexpectedly stopped.” After the wheel jammed, McMillan claims it caused her to lose her balance and fall, “resulting in significant injuries.”

McMillan’s attorneys argue that Winn-Dixie was negligent and owed their client a duty to correct the situation before potential accidents.

McMillan alleges that she sustained “permanent injury to her body as a whole,” pain and suffering “of both a physical and mental nature,” disability, physical impairment, a loss of capacity for the “enjoyment of life,” and several other losses.

The lawsuit claims the losses are “permanent or continuing” and that McMillan will continue to suffer from them in the future.

McMillan is seeking in excess of $50,000 in damages, exclusive of attorney’s fees. She is being represented by Orlando-based law firm Morgan & Morgan.
