Ashtray-throwing Ocala man jailed after spat with woman who feared for her life

An Ocala man is in the Marion County Jail for allegedly holding a woman against her will and battering her during a domestic dispute.

James Eugene Daniel, 43, was charged with domestic battery and false imprisonment after the incident, which happened early Tuesday at his residence on SW 33rd Terrace. He remains held on $4,000 bond, with a Marion County Court date of May 21.

A Marion County sheriff’s deputy responded to a 911 call in which the victim whispered Daniel “might kill me before deputies arrive.” Upon the deputy’s arrival, the victim said Daniel was intoxicated and wasn’t letting her leave the residence, according to the arrest report.

The victim said she was in her bedroom and Daniel was in the living room. She said she thought Daniel had passed out from being intoxicated, so she quietly walked to the front door and unlocked it. She said Daniel stood up and said, “You’re not (expletive deleted) going anywhere. Go back to the room.” The victim said she was afraid, so she complied, according to the report.

The victim said as she was walking to the bedroom, Daniel threw a cigarette ashtray that struck her in the lower back. She said Daniel then walked towards her and kicked her in the left buttocks. The deputy was unable to observe her injuries due to their location, but he located the ashtray that allegedly was thrown, according to the report.

Daniel denied all the allegations, and the deputy observed him yelling, cursing and calling the victim a derogatory name multiple times before being arrested.
