Accused batterer gets black eye from witness

A North Florida man received a black eye from a witness who reportedly stopped him from beating up a woman outside an RV.

Brian Mark Milton, 34, of Maccleny, was charged with domestic battery after the incident, which happened recently. The incident location was redacted from the Marion County Sheriff’s Office report.

A sheriff’s deputy found Milton being held down by two male witnesses and placed him in the back of the patrol vehicle. The witness who reported the incident said he saw the victim outside her RV when Milton came out of it and swung at her with a closed fist. He said Milton and the victim went back inside the RV and he heard multiple “bangs” that sounded as if someone was hitting the walls, according to the report.

The witness said the victim ran out of the RV saying, “He just hit me.” He said Milton was chasing the victim and he intervened, punching him in the face and holding him on the ground. The witness said he was afraid Milton was going to harm the victim if he did not intervene, the report said.

The second witness told the deputy he heard the victim scream when she ran out of the trailer. He said he saw Milton chasing the victim when the first witness intervened. He said he helped the first witness hold Milton down until the deputy’s arrival, according to the report.

The victim told the deputy she was outside the RV when Milton came out with a balled fist and approached her yelling. She said she doesn’t know why Milton was acting that way, but he might have been made because she was texting somebody else earlier, the report said.

The victim said she and Milton went back into the RV and were in a verbal argument when he punched her in the neck. She said she ra out of the RV to the first witness’s RV and does not recall what happened afterwards, according to the report.

The deputy observed redness on the right side of the victim’s neck, which corresponded with her story. The victim also had a mark on her left eye that appeared to be older. She said it was from two weeks ago and Milton had done it to her. The victim said Milton has battered her in the past and she has neglected to report it to law enforcement, the report said.

After being read his Miranda warning, Milton said he was having a verbal argument with the victim. He said he came out of the RV and wanted her back inside because the way she was acting was “embarrassing.” Milton said once they were back inside, they started to argue and she decided to run out of the house and scream he had hit her, according to the report.

Milton said he did not hit the victim and she freaked out for no reason. He said he ran after her and got hit really hard, and he doesn’t remember much after that. Milton said he didn’t want to pursue criminal charges against the witness for battery, the report said.

Milton was released from the Marion County Jail on $2,500 bond and is scheduled to appear in Marion County Court on Sept. 8.
