Man puts up fight while being arrested on domestic battery charge

A 19-year-old man who has been accused of domestic battery in the past but never convicted was arrested Wednesday afternoon, hours after deputies were first called to his residence and told by the victim that the fight was only verbal.

Elijah Mateo Johnson Orozco was charged with simple battery and resisting an officer without violence. Marion County sheriff’s deputies had to place him in a hobble restraint after he pulled away from them multiple times as he resisted being put into the back of a patrol car.

The victim said law enforcement was called when she and Orozco got into an argument on New Year’s Eve, but she didn’t want to make a report at that time because she just wanted to leave the residence. Sheriff’s office records show deputies responded to the residence at 12:18 a.m.

The victim said she and Orozco got into an argument that led to Orozco pushing her onto the bed. She said while she was on the bed, Orozco “hovered” over her by looking down at her while standing over her. The victim said she was in fear and she put her leg up to defend herself, and Orozco swung at her three times with closed fist. She said he connected once in the head and once in arm while missing the third time, according to the sheriff’s office report.

The deputy observed a bloody bruise on the victim’s head. The victim said there have been four to six previous incidents of domestic violence between the two parties. She provided a written statement of the incident, the report said.

A records search revealed the victim reported a domestic battery on April 3, 2019, but there was no arrest. A criminal history check revealed Orozco has not been convicted of domestic battery, according to the report.

Deputies tried to make contact with Orozco and the victim’s residence. As they arrived, the victim was knocking on the door and a deputy observed Orozco walking towards the door with a handgun. The deputy ordered Orozco to put the gun down and he complied. He was placed in handcuffs and led to the patrol car, where he started resisting, the report said.

Orozco, who refused to speak to deputies about the incident, was taken to the Marion County Jail. He is being held on no bond and is due in court on Feb. 12 at 1:30 p.m.
