A 33-year-old Ocala man who recently got out of jail was arrested again Monday after he allegedly went on a destructive rampage when his mother’s live-in boyfriend told him he had to move out.
Todd Warren Falk, of 2 Poplar Court, was charged with criminal mischief and simple assault by threatening to commit domestic violence. He was previously released May 9 after three weeks in the Marion County Jail on a domestic battery charge, and he was also arrested in August 2019 for resisting an officer with violence, battery on an officer or firefighter, criminal mischief, petit theft and failure to appear.
In the latest incident, the victim told a Marion County sheriff’s deputy that he, Falk and Falk’s mother have been living at the Poplar Court address as a family unit for about two months. He said he and Falk had been arguing throughout the day due to Falk drinking all day and being “drunk,” according to the sheriff’s office report.
The victim said he told Falk he didn’t want him staying at the residence any longer and Falk became aggressive towards him. He Falk told him he was going to “beat his ass,” and he was afraid he was going to batter him. The victim said he retrieved a knife to protect himself in case Falk tried to harm him, the report said.
The victim said Falk’s mother escorted Falk out of the house through the front door in an effort to de-escalate the situation. He said once Falk was out front, his mother locked the front door. The victim said he was looking out the living room window when he saw Falk strike the driver’s side window of his 2019 Mitsubishi Outlander until it broke. The deputy observed the vehicle window was broken with glass covering the driver’s seat and on the ground by the driver’s door. The victim estimated the damage to be approximately $400, according to the report
The victim said while he was on the phone with 911, he heard the front window of the residence break. The deputy observed two windows to the left of the front door were broken with glass on the ground in front of them. The deputy also saw where Falk reportedly pulled the sliding glass door off its track, the report said.
Falk’s mother said she didn’t see the incident that happened outside because she was locked in a bedroom with her sick father, who had just returned to the residence from the hospital a few hours before the incident. She said she could hear the glass breaking but didn’t see the incident, according to the report.
Falk, who left the scene on foot before the deputy arrived, was picked up by another deputy while walking in the area of Chestnut Road and SE 58th Avenue and brought back to the incident location. The deputy tried to read Falk his Miranda warning but was unable to do so because Falk was continually talking over him, the report said.
Falk was taken to the Marion County Jail, where he agreed to speak with the deputy but was difficult to understand because of his slurred speech. Falk said he wanted to get his property from the incident location. He started talking about his sick grandfather and then said he didn’t want to talk anymore, according to the report.
Falk is being held without bond and will appear in Marion County Court on Aug. 4.
