Phone-throwing Citra man arrested after fight over loud rap music

James Daniel Moore

A Citra man stands accused of slapping a woman and throwing her cell phone against the wall to keep her from calling 911.

James Daniel Moore, 43, of NW 21st Court, was charged Saturday night with domestic battery and obstructing justice by tampering with the victim. The victim told Marion County sheriff’s deputies that she, her juvenile daughter, and a male witness were in the garage playing darts when Moore came in and started an argument with the witness. The victim said she got between Moore and the witness to try to stop the altercation, according to the sheriff’s office report.

The victim said Moore became aggressive with her and slapped the right side of her face. She said when she stated she was going to call 911, Moore grabbed her phone, threw it against the wall and left the residence. An officer observed a red mark on the victim’s face, the report said.

The victim’s daughter and the witness described the incident exactly as the victim did. Moore returned home while the deputy was still conducting his investigation. He told the deputy he walked into the garage because the victim, the juvenile, and the witness were playing loud rap music, according to the report.

Moore said he told them to turn down the volume because he doesn’t like rap music. He said he and the victim got into a verbal altercation and she pushed him. Moore said he didn’t slap the victim, the report said.

Moore was arrested and taken to the Marion County Jail. He was released the next day on $1,500 bond and will appear in Marion County Court on July 16.
