Umatilla man accused of battering woman he says wouldn’t ‘shut up’

David Dwayne Cant Jr.

An Umatilla man in jail on a domestic battery charge told Marion County sheriff’s deputies he pushed the victim because she wouldn’t “shut up.”

David Dwayne Cant Jr., 36, was arrested Wednesday at his residence on of SE 146th Place in connection with the incident, which happened Saturday afternoon. The deputies were unable to locate the victim at the time of the incident, according to the sheriff’s office report.

The victim’s father, who reported the incident, told deputies he was at his daughter’s residence and saw Cant become irate and begin to yell and scream at the victim. He said Cant grabbed the victim by the hair and threw her to the ground, and then struck her with a closed fist in the right eye region. The victim’s father said when she walked past him, he observed a red mark that was swollen above her right eye, the report said.

The victim’s mother, who lives across the street, said she overheard loud yelling. She said she looked out her window and saw Cant grab the victim by the hair and swing her around the yard, according to the report.

Contacted Wednesday, the victim said she and Cant got into a verbal argument that escalated into a physical altercation. She said she was across the street from her home, pruning trees, when Cant came to her location and began to yell and scream at her. She said he grabbed her by the hair and threw her to the ground, the report said.

Cant told the deputy that he and the victim got into an argument over the shed door being broken. He said the victim wouldn’t shut up and continued to yell at him. Cant said he walked over to where the victim was and pushed her to the ground. He said it was out of impulse because she wouldn’t shut up, according to the report.

Cant was charged with domestic battery (second or subsequent offense) and taken to the Marion County Jail, where he was being held Thursday on $1,000. He’s scheduled to appear in Marion County Court on Oct. 8.
